MIAMI COUNTY — On Monday, Brandon McGill, 33, of Troy, was sentenced to serve 30 months in prison for threatening a Miami County Municipal Court magistrate Sept. 1.
McGill was charged with third degree felony intimidation for threatening Magistrate Gary Zuhl during an arraignment for resisting arrest and misdemeanor assault charges.
Assistant Prosecutor Paul Watkins said McGill voiced a variety of threats to law enforcement officials on Sept. 1, saying he would “bury” the public official. McGill also stated he would “put a bullet in his head” as well as threatening to kill Zuhl upon his release from jail.
Prior to sentencing, McGill told Judge Jeannine Pratt he had written a letter of apology to Magistrate Zuhl.
“My mind didn’t catch up with my mouth,” said McGill prior to sentencing. McGill said he suffers from a variety of mental health issues and claimed he had changed medications prior to the incident. Zuhl did not provide a victim impact statement.
Judge Pratt listed McGill’s criminal history, including his 10 probation periods. Pratt found McGill expressed no genuine remorse for threatening the public official. McGill received 19 days of jail credit. He will serve three years of post-release control.
