TROY — A Troy man has been charged with six counts of third degree felony unlawful sexual conduct with a minor following a search warrant at his Troy apartment Monday.
According to Capt. Jeff Kunkleman, Shawn Whitaker, 30, was arrested and incarcerated on the charges Monday morning.
Whitaker was arraigned in Miami County Municipal Court on the charges Tuesday. His bond was set for $300,000 on all charges.
Detectives conducted a search warrant at his residence in the 400 block of Stonyridge Ave. Monday morning. The search warrant was filed due to a complaint made by a female juvenile through the Montgomery County Children Services regarding alleged illegal sexual activity. Computers and other equipment were seized as part of the warrant service.
According to the report, the 15 year-old foster child left her residence last November and stayed with Whitaker, whom she met at a foster home. According to the victim’s statements, Whitaker allowed her to stay at his home where the alleged sexual acts occurred. Officers recovered photographs and video recordings of a sexual nature of the victim on Whitaker’s cell phone and computer obtained by the search warrant. According to reports, after he was arrested, Whitaker admitted he had consensual sex with the victim multiple times before and after he learned she was a minor.
The FBI’s Violent Crimes Against Children task force assisted the Troy Police Department during the investigation and interview process.
Whitaker remains incarcerated at the Miami County Jail. His pre-trial was set for March 28 with Judge Elizabeth Gutmann presiding.
Dayton man charged with felony rape
The West Milton Police Department charged Brandon David Fultz, 31, of Dayton, with one count of first degree felony rape following a report filed on March 18.
According to the report, a 27-year-old female alleged Fultz had non-consensual sexual conduct with her as she slept in her living room on the sofa on March 14. According to the police report, Fultz admitted to improper sexual contact with the woman as she slept to “check and see if she was sleeping with another man.”
Fultz was arraigned on the charge on Monday. His bond was set for $100,000. His preliminary hearing is set for March 30 with Judge Gutmann presiding.
