Information provided by the Miami County Sheriff’s Office

July 19

OVI: A deputy stopped a white GMC truck for a moving violation at N. Sayers Rd. and State Route 55, Troy, and made contact with the driver who was identified as the defendant James T Holzen. After further investigation Mr. Holzen was found to be under the influence of alcohol and was taken into custody for OVI.

TRESPASSING: A deputy was dispatched to the 7000 block of S. State Route 202, Tipp City, on a suspicious vehicle. While en route to the residence dispatch advised the victim was following the suspect vehicle and they had turned west onto State Route 571 from State Route 202. The suspect vehicle was described as a red truck pulling a trailer filled with scrap metal and car parts. The deputy was able to catch up to the vehicles at the intersection of Main and Sixth St., in Tipp City. The deputy made contact with the reporting party and she advised the vehicle had entered the property from Ross Rd. and had been by the barns. The vehicle exited the property via the lane to State Route 202 and the occupants yelled something about her dogs. The reporting party tried to get the vehicle to stop but it continued on without doing she began to follow it. In making contact with the occupants of the vehicle, the driver, Jimmie Hartl, told me he had used the driveway as a turn around. The deputy asked him where the scrap metal (truck parts, radiators and load locks) had come from and he told me Michigan and Dayton Freight in Huber Heights. Contact was made with Huber Heights Police Department and they were able to confirm with Dayton Freight security Mr. Hartl had picked up scrap metal from them. The security officer did advise Mr. Hartl did not remove any radiators from their property. The reporting party advised she wanted to press trespassing charges against Mr. Hartl as she felt he was looking for scrap metal to take from the property. A statement was obtained from the reporting party and photographs of Mr. Hartl’s truck and trailer along with the contents were taken. Mr. Hartl was issued a citation for trespassing and an unsecured load (pieces of metal were found on Main St. by the railroad tracks from Mr. Hartl’s trailer) and released.
