MIAMI COUNTY — A Troy teen who allegedly raped a female child under the age of 13 waived his right to a preliminary hearing in Miami County Municipal Court on Tuesday.
Nicholas Ferguson, 19, of Troy, remains in Miami County Jail with a bond of $500,000. He was arraigned on charges of first degree felony rape last week. The case will go to Miami County Common Pleas Court.
• Andrew Wagner, 42, of Piqua, was sentenced to serve two 10 months sentences, to run concurrently, for two counts of fifth degree felony possession of drugs. Wagner was found guilty by a trial jury of possession of syringes which contained cocaine and heroin during an arrest on Nov. 9 by Piqua Police Department. Wagner received 11 days jail credit and ordered to pay $125 restitution fee to Piqua P.D. for its testing fee. Upon release, Wagner will be placed on three years post release control.
• Andrew Miller, 33, of Sidney, was sentenced to serve 10 months in prison for one count of fifth degree felony drug possession. He was arrested by Tipp City Police Department on Dec. 9, 2014. Miller received 3 days of jail credit and ordered to pay $125 restitution fee to Tipp City P.D. for its testing fee.
• Josh Hoffpauir, 28, of Piqua, was sentenced to 90 days in the Miami County Jail for receiving stolen property. He was arrested on the charges by Piqua Police Department on March 21. Hoffpauir is to pay $213.50 to the victim. Upon release, Hoffpauir will serve three years on community control, abide by a 9 p.m. to 6 a.m. curfew and undergo drug and alcohol counseling and mental health assessments. If Hoffpauir violates the conditions, he could serve up to 17 months in prison. He received 9 days of jail credit. Miami County Common Pleas Judge Jeannine Pratt also ordered Hoffpauir to clear his two outstanding warrants in Louisiana upon release.
